SINCERELY MERAKI TERMS OF SERVICE
AGREEMENT
By visiting our site and/or placing an order with us, you engage in our service and therefore agree to be legally bound by the following terms and conditions made by Sincerely Meraki. This Terms of Service applies to all users of the site and its Terms and Conditions may be modified at any given time with no notification.
GENERAL
We reserve the right to refuse any orders and/or inquiries you place with us. In the event that we cancel your order, you will be notified ASAP via e-mail and/or phone number provided at the time the order was placed, and issued a full refund automatically.
This store is hosted by Squarespace, and payment is hosted by Stripe. You understand that your information (name, phone, credit card), may be transferred unencrypted over various networks. Credit card information is always encrypted.
We are not liable to you for any transactions you make with any third party accounts/services/sites posing as Sincerely Meraki. The only way you can order a cake from us is through our website (sincerelymeraki.com).
PRODUCTS AND SERVICES
You understand and accept that your cake is not going to look exactly as the one pictured on our site and/or social media (instagram) to the T. Each cake is handmade and “one of a kind” with minor and unique differences, but will generally replicate the design you have selected with all its original accents and elements.
We match custom colors to the best of our ability but can not guarantee your monitor will display the color accurately to how we see it on our monitor (computer/phone/tablet/etc). In addition, the color of your cake can look different depending on the photo, lighting, and/or surrounding environment.
We reserve the right to some artistic changes/freedom for each cake when necessary and will communicate any such changes to the client beforehand.
Products can have price changes, be modified, or discontinued at any time without notice.
We are not liable to you for any modifications, price changes, or discontinuance of products and/or services.
You agree not to copy and sell any portion of our products, designs, and/or services posted on our website and/or social media (Instagram) without written consent from us.
We do not directly copy cake designs from other cake shops. We reserve the right to turn away and refuse any requests that asks us to copy another shop’s cake design.
CAKE ORDERS
PLACING ANY CAKE ORDER DOES NOT GUARANTEE ORDER CONFIRMATION OF FULFILLMENT. It is only confirmed once you receive an ORDER CONFIRMATION email. We try our best to fulfill all incoming orders, but it is possible we can not guarantee your order based on custom requests, booking availability, and/or having limited resources. If your order can not be fulfilled, we will notify you ASAP via email and/or phone number provided at the time the order was made and issue a full refund immediately.
You understand and agree that Sincerely Meraki cakes are purchased (100% of the cost) upfront first before your order is officially confirmed, before Sincerely Meraki can begin its production, and before you receive the cake.
We reserve the right to refuse and cancel any order you place with us and/or limit/change order quantities placed.
We reserve the right to refuse any orders/inquiries if the client is deemed unfit for our cake shop.
For orders placed last minute within our given advised time frame, the clients are subject to receiving a surcharge for their order.
Large orders/wedding orders (100+ servings) are required to be placed at least 2 months in advance of event date.
PRICING
We reserve the right to change our prices for our products/services at any time without notice.
Clients are required to purchase a consultation fee if they are looking for a cake consultation. Sincerely Meraki reserves the right to discontinue conversation and/or not partake in the client’s inquiry until he or she has purchased a cake consultation.
The price for a custom designer cake will vary based on the final design itself and cake size, which will be determined by Sincerely Meraki. The price will be transparently communicated to the client. Clients must purchase their custom designer cake first to secure and finalize their order in order for Sincerely Meraki to proceed production of said cake.
We do not tolerate bargaining and/or negotiating of cake prices or any other services we provide and reserve the right to refuse and/or discontinue our services to those who participate in this action.
ORDER CANCELLATIONS/CHANGES/REFUND POLICY
Cancellations: Clients may cancel their order with more than 30 days advance notice from the fulfillment date for a full refund in the original form of payment. If the order is cancelled within 29 and 15 days from the fulfillment date, a 50% refund will be issued in the original form of payment. If the order is cancelled within 14 and 0 days from the fulfillment date, no refund will be issued.
Pickup Time Changes: Should there be any changes, clients can change their pickup time by letting us know ahead of time ASAP. We will let you know if the change will work with our schedule or not as we may have other pickups/deliveries to facilitate.
Date Changes: In the event that the client needs to postpone the pickup date to a later date, the client must let us know at least 10 days before their original scheduled pickup date. Clients can not change their pickup date to an earlier date under any circumstances. If a client needs to postpone their pickup date within 10 days of their original scheduled pickup date, the client then forfeits the original order (no refund will be issued) and has to re-order for their new desired pickup date. The client can then choose to pickup their cake or not at the original pickup date.
Design Changes: Clients may change their design with more than 10 days advance notice from the fulfillment date. Changes are subject to an additional charge or refund, depending on the change requested. Design changes will no longer be accepted within 9 days from the fulfillment date.
Flavor/Quantity Changes: Clients may change the flavor and quantity of their order with more than 20 days advance notice from the fulfillment date. Changes in quantity are subject to an additional charge or refund, depending on the quantity change requested. Flavor and quantity of cake changes will not be accepted within 19 days from the fulfillment date.
Sincerely Meraki can’t fulfill the client’s order: In the unlikely event that Sincerely Meraki can not fulfill our client’s order/our books are full, clients will be notified ASAP to see if re-scheduling is an option. If not, a full refund will be issued back in the original form of payment.
Cake Consultation: If Sincerely Meraki is not able to fulfill the client’s request upon the initial review of the consultation form submitted with a “Cake Consultation” purchase, we will notify the client via the email he/she has provided us with and issue back a full refund in the original form of payment. Besides that, a cake consultation is non-refundable and the order cannot be cancelled.
S,M Gift Card: Purchase of an S,M Gift Card is non-refundable.
We reserve the right to change our order cancellations, changes, and refund policy at any given time without notice.
CAKE DAMAGES
Pickups: Sincerely Meraki assumes no liability or responsibility to cake damages after the cake(s) are placed in the client’s possession (car, hands).
Deliveries: Sincerely Meraki assumes no liability or responsibility to cake damages after the cake(s) have been delivered to the delivery address and handed off to the point of contact/recipient.
CLIENT FEEDBACK
If you send us comments and/or feedback, you agree that we may, at any time, publish and/or distribute any of those comments. We are not obligated to maintain any comments in confidence.
TERMS OF SERVICE CHANGES
We reserve the right to update and change any part of this Terms of Service, on this page. It is the client’s responsibility to check our website periodically for any changes or updates made.
